Freedom Falcon Academy Terms of Service

Welcome to Freedom Falcon Academy (FFA). By accessing or using our website and services, you agree to comply with and be bound by the following Terms of Service (ToS). Please read these terms carefully. If you do not agree with any part of these terms, you must not use our services.

1. Terms of Participation

  • Eligibility: To participate in FFA courses, you must be at least 16 years old and have the legal capacity to enter into a contract.
  • Required Equipment: To fully participate in our courses, you will need access to a laptop or desktop computer and an estimated $900 for necessary tools and software.

2. Ownership of Content and Intellectual Property

  • Proprietary Rights: All content, materials, logos, designs, and intellectual property provided by FFA are the sole property of FFA. You are granted a limited, non-exclusive license to access and use the content for personal, non-commercial purposes only.
  • Restrictions: You are strictly prohibited from copying, sharing, reselling, distributing, or creating derivative works from any FFA content without prior written consent.

3. Code of Conduct

  • Behavioral Expectations: We expect all users to engage respectfully and professionally within the FFA community. Harassment, spam, self-promotion, or any illegal activities are strictly prohibited.
  • Community Interaction: The FFA community is moderated by our team, and we reserve the right to remove any content that violates these terms or is deemed inappropriate.

4. Payment Terms

  • Payment Options: FFA offers both one-time payment and installment payment options (up to 6 months) for our courses. All payments are processed securely through Kajabi, and you agree to abide by Kajabiā€™s terms and conditions when processing payments.
  • Failed Payments: In the event of a failed payment for installment plans, access to course content may be suspended until payment is completed.
  1. Refund and Cancellation Policy
  • Refund Policy: You are eligible for a full refund if you have consumed 49% or less of the course video content and submit your refund request within 60 days of your purchase. Our refund policy is outlined separately and can be accessed [here]. By enrolling in an FFA course, you agree to the terms of this refund policy.
  • No Refund Upon Termination: If your access is terminated due to a breach of terms or non-payment, you will not be entitled to a refund.

6. Limitation of Liability

  • Scope of Liability: FFA, its affiliates, and licensors are not liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your access to or use of our services. This includes, but is not limited to, data loss, unauthorized access, and any reliance on course content.
  • Monetary Cap: Our liability is limited to the amount you paid for the course or service, regardless of the nature of the claim.

7. Dispute Resolution and Arbitration

  • Binding Arbitration: Any disputes arising out of or relating to these ToS will be resolved through binding arbitration, rather than in court, except for matters that may be taken to small claims court.
  • Class Action Waiver: You agree to resolve disputes with FFA on an individual basis and waive your right to participate in a class-action lawsuit or class-wide arbitration.
  • Governing Law: These ToS are governed by the laws of the State of Kentucky, USA, without regard to its conflict of law principles.

8. Termination

  • Conditions for Termination: FFA reserves the right to terminate or suspend your access to our courses and services at any time, without notice, for breach of these terms or non-payment.
  • Effect of Termination: Upon termination, your license to use FFA content ceases immediately, and no refunds will be issued.

9. Affiliate Disclosure

  • Affiliate Links: Some of the links on our website or within our course materials may be affiliate links, meaning we may earn a commission if you purchase through those links. We will always disclose affiliate links in accordance with applicable laws and regulations.
  • User Contributions: User-generated content containing affiliate links is not permitted and will be removed.

10. Modification of Terms

  • Right to Modify: FFA reserves the right to modify these ToS at any time. Changes will be effective immediately upon posting to our website. It is your responsibility to review these terms regularly.
  • Acceptance of Changes: Continued use of our services after any changes to the ToS constitutes your acceptance of the modified terms.

11. Global Compliance

  • GDPR Compliance: For users in the European Union, FFA complies with the General Data Protection Regulation (GDPR) concerning the collection, use, and storage of personal data.
  • CCPA Compliance: For California residents, FFA complies with the California Consumer Privacy Act (CCPA), ensuring your rights regarding data access, deletion, and sharing are protected.

12. Interactive Features and User-Generated Content

  • Community Guidelines: We encourage active participation in our student community but require all interactions to adhere to our community guidelines. Content that is inappropriate, self-promoting, or spam will be removed.
  • Moderation: Our team actively moderates user-generated content and reserves the right to remove or edit content that violates our guidelines.

13. Miscellaneous

  • Severability: If any provision of these ToS is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.
  • Entire Agreement: These ToS, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and FFA regarding the use of our services.
